Practical advice on debt recovery

Once a claim has been served, the debtor generally has 28 days to either pay the full amount claimed (including costs) or file a notice of intention to defend and a defence setting out the grounds of dispute. In some cases, the debtor may seek to negotiate a reduced settlement or enter into a payment arrangement.

Our debt recovery lawyers can assist with:

  • Negotiating full payment of the claim or an agreed settlement, including structured payment arrangements where appropriate
  • Preparing and formalising settlement or repayment agreements to protect your position in the event of default
  • Assessing the merits of any defence filed and advising on the appropriate next steps, including whether summary judgment may be available
  • Progressing the matter to hearing where required
  • Applying for default judgment where no defence is filed within the required timeframe

If a defence is filed, we will assess its merits and advise on whether the matter can be resolved promptly or should proceed to hearing. If no defence is filed, we can apply for default judgment and take steps to recover the outstanding debt.

Enforcing a judgment

Our debt recovery lawyers advise on the available options to enforce a judgment and recommend the most appropriate course of action based on your circumstances.

If information about the debtor’s financial position is limited, we can undertake searches or require the debtor to provide a financial statement. If the debtor fails to comply, we can apply to the court for an order requiring them to attend and disclose their financial position.

Once the debtor’s financial position is established, we will advise on the most effective enforcement strategy.

Enforcement options may include:

  • Enforcement warrant – redirection of earnings, including garnishee of wages
  • Enforcement warrant – seizure and sale of property, including real estate or other assets such as vehicles
  • Issuing a creditor’s statutory demand where the debtor is a company
